Eminent Domain and Takings Issues
I represent governmental bodies as well as citizens in disputes that arise when the government decides to take private property for public purposes. The law allows the government to take property for such public uses as public roads, parks, city buildings, schools and other public uses, but requires that there be just compensation paid to property owners for the taking.
As an example, the state of Ohio will be exercising the right of eminent domain to purchase private property along the I-75 corridor in the Queensgate area of downtown Cincinnati to replace the Brent Spence Bridge that separates Ohio from Kentucky.
I recently served as co-counsel for the City of Norwood in its epic eminent domain case that was eventually decided by the Ohio Supreme Court in 2006.
I have also been involved in a variety of cases in which property owners claimed that their property rights were "taken" by governmental actions or regulations leading to a substantial diminution or complete elimination of the property's value.
I have also spoken at a number of seminars about eminent domain and takings claims issues. For example, I spoke at the 2006 American Planning Association's National Conference in San Antonio, Texas about eminent domain in Ohio and the City of Norwood's experience. Land Use and Zoning Disputes
I work with local government units, including cities, villages, counties and townships, on land use and zoning matters, where citizens have challenged either the classification of property or administrative decisions on variances, conditional uses and interpretations. I prefer to consult with local government officials before zoning decisions lead to litigation but frequently serve as special counsel after litigation has been filed. I have extensive experience, and an outstanding track record, in defending zoning and land use decisions in Ohio's appellate courts.
Taxpayer Actions
I represent individuals and municipalities in litigation alleging misuse or abuse of corporate powers by government officials. This can also include efforts to recall elected officials.
Board Training
I frequently present seminars on proper zoning practices for planning and zoning commissions, as well as boards of zoning appeals. With over twenty years of teaching experience as an adjunct faculty member at the University of Cincinnati, I have experience presenting complex legal issues in an understandable way to non-lawyer, board and commission members.
